Conditional Rebate Offer
TERMS AND CONDITIONS
HOW IT WORKS: Eligible customers may register for the Conditional Rebate Offer (the “Offer”) by going to https://bluwaterbistro.com/hawks/ (the “Website”) between September 1, 2022 at 12:00:00 a.m. Pacific Time (“PT”) and February 11, 2023 at 11:59 p.m. PT (the “Qualification Period”) and following the on-screen instructions to register for the Offer. Then, every time you dine at Bluwater Bistro (“Sponsor”) following registration, save your receipt. If the “Activation Event” (as described below) is satisfied, all eligible customers, as determined by Sponsor at its sole discretion, will receive a check in the amount of their combined dining costs (not including alcohol, sales tax or tips) made following registration and through the end of the Qualification Period, up to a total maximum payout of $400,000 (“Total Maximum Payout”). Registered customers will be contacted should the Activation Event occur with instructions on how to submit their receipts (or other acceptable proof of purchase, e.g. a credit card statement) for refund. It is the sole responsibility of eligible customers to retain their receipts for verification purposes. All requests for refund are subject to verification by Sponsor. In the event the Total Maximum Payout is exceeded, refunds will be made pro-rata at Sponsor discretion up to the Total Maximum Payout. Sponsor’s decisions are final on all determinations of refund amounts. Sponsor is not responsible for lost or illegible receipts. The Offer is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

To request an entry without making purchase (the “AMOE”), click here: https://amoesite.com/entry.php?key=957zb4lzpw (the “AMOE Website”) and complete the request form in its entirety with your full name, email address, complete mailing address (including city, state and zip code), and telephone number. Once the request form is completed, follow the instructions to print out the form and affix the bar code to a post card with first class postage and mail to: Enter the Seattle Professional Football Team Big Game Conditional Rebate Offer, 3030 LBJ Freeway, Suite 300, Dallas TX 75234. Limit one barcode per postcard. Barcodes entries sealed inside an envelope will not be accepted. Limit one (1) entry request (per person per day) Entries received from the same individual in excess of this limit will be voided and are not eligible for prize awards. All requests must be received by February 17, 2023. No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail. In the event the Activation Event is satisfied, all those who registered, but did not make a purchase, will receive a check in the amount of the average refund amount made to those who submit receipts.
By participating in the Offer, eligible customers unconditionally accept and agree to comply with and abide by these Terms and Conditions and the decisions of Bluwater Bistro, 102 Lakeside Ave., Seattle, WA 98112 (“Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY: The Offer is open to legal United States residents residing in Washington, who are eighteen (18) years of age or older. Employees, officers and directors of Sponsor, its parent, subsidiaries, affiliates, advertising and promotion agencies (collectively, the “Offer Entities”) and the immediate family members, and/or those living in the same household of each, are ineligible to participate in the Offer.
ACTIVATION EVENT: In order for the Offer to be activated and the refund amount to be provided to eligible customers, the Seattle Professional Football Teams must win the National Football League’s Big Game currently scheduled to take place on February 12, 2023 (or as may be rescheduled for any reason) at State Farm Stadium in Glendale, AZ.
REBATE AWARD & DELIVERY: In the event that the Activation Requirement is met and satisfactorily verified per these Terms and Conditions, each eligible customer will receive a notification via the email address registered with Sponsor with details on how to claim a rebate and deadline dates for making a claim. Please allow thirty (30) days for verification of receipts and receipt of the rebate check. In the event the Activation Requirement is not met, then the Offer is void, and there will be no rebate, refund or compensation in any manner to any eligible customer.
Sponsor reserves the right to require eligible customers to provide proof of eligibility and/or purchase prior to providing a rebate check. Customer is responsible for any applicable federal, state and local taxes associated with the receipt of the rebate check. In the event any customer receives a rebate check valued at $600 or more, Sponsor will require such customer to complete an IRS W-9 form.
GENERAL: In the event an eligible customer receives a rebate check, and is later found to be in violation of these Terms and Conditions he/she will be required to reimburse Sponsor for the total amount of the rebate received. Participation constitutes permission for the Sponsor and its designees to use rebate recipient’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation, unless prohibited by law.
Customers agree that Sponsor shall not be responsible or liable for, and is hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Offer. Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due rebate checks or notifications. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the operation of the Offer or to be acting in violation of these Terms and Conditions, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Offer, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF WASHINGTON WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
